Transgender documentarian Sam Feder's newest documentary "Heightened Scrutiny" offers a powerful dual viewpoint – both an intimate portrait of a key trans advocate and a sharp analysis of media coverage surrounding transgender existence.

Judicial Battle at the Highest Court

This feature documents ACLU attorney Chase Strangio as he prepares for oral arguments in the important highest court case US v Skirmetti. This legal battle occurred in late 2024, with the court finally ruling in favor of the state's argument, essentially permitting limitations on healthcare for transgender youth to stay in place across multiple US territories.

We made Heightened Scrutiny in merely 16 months, stated Feder during a conversation. By contrast, my previous film Disclosure took me five years, so this was very accelerated. Our purpose was to raise discussion so people would understand more about the case.

Human Narrative Amid Political Battle

Although Feder offers a extensive examination of how major publications have spread transphobic talking points, the film's most valuable contribution may be its compelling depiction of Strangio. Typically a measured attorney in media settings, Strangio shows his humanity throughout the production.

That was a major challenge, to reveal parts of my life to a camera lens that I had worked hard to keep private, stated Strangio. Sam explained he wanted future generations to know that we fought, to see what was done in service of these struggles for our basic existence.

Intimate Scenes Beyond the Legal Battle

This film also features touching moments where Feder moves beyond the constant political struggle, including footage of Strangio vacationing in Italy and receiving a body art featuring words from activist Pauli Murray's poem "Prediction."

The tattoo moment is one of my preferred parts in the movie, shared Strangio. Being tattooed is almost like a reflective process for me, to be totally engaged in my body and to think of it as a container for things that are important to me.

Physical Identity and Portrayal

Feder's focus to lovingly documenting Strangio getting to his tattoo collection highlights that Heightened Scrutiny is essentially about trans bodies – not only those of young people who confront prohibition of their right to live genuinely in their own bodies, but also the physical forms of the many participants who participate in the production.

I create films with a meaning, and part of that is picking people who are brilliant and concise enough to hold the camera, explained Feder. When people ask me what they should wear for an interview, my answer is anything that makes you feel attractive. This is essential to me – as trans people, we struggle so much with our self-perception.

A key element that causes Feder's works shine is his obvious skill for making his trans participants feel at ease, acknowledged and admired. This technique creates genuine chemistry between Feder and Strangio, allowing the director to accomplish his goal of presenting Strangio as a complete individual and providing a document for future generations of how determinedly he and others have struggled for trans rights.

I hope not people to end up in a situation of incessant despair because of what the law is failing to provide us, explained Strangio. I strive to be in a process of using the law to lessen harm, but not to turn it into some sort of pathway for our freedom possibilities. Official institutions is not going to be the mirror through which we see ourselves. Our community are that mirror, and it's extremely crucial that we keep having that conversation alongside discussions about pushing against these policies and practices.
